How Texas reviews homeowners rates

Most Texas homeowners insurers file rates under a file-and-use system in Chapter 2251 of the Texas Insurance Code: an insurer may use a rate on and after the date it files it. The commissioner must disapprove a filed rate that does not comply with the law by the earlier of its effective date or the 30th day after filing, and can extend that review once. A rate already in effect can be disapproved only after a hearing.

The Texas FAIR Plan Association, which provides residential property insurance in underserved areas, is excluded from that chapter. It files proposed rates that the commissioner must approve or disapprove under Insurance Code Section 2211.056.

TDI reported that of 2,078 property and casualty rate filings it reviewed in 2025, 126 were withdrawn, 81 were rejected for technical reasons, none were disapproved, and 1,871 were allowed to stand or approved.
