How California reviews homeowners rates

California uses prior approval. Under Proposition 103, the Insurance Commissioner must approve a homeowners rate before an insurer uses it. After a filing is publicly noticed, the department has 60 days to approve it or issue a notice of hearing; if it does neither, the filing is deemed approved.

Any member of the public can request a hearing within 45 days after a filing is publicly noticed. If a personal lines rate change exceeds 7%, the Commissioner may be required to hold a hearing on a timely consumer request. Intervenors who take part in rate proceedings can recover their costs from insurers.
